When Hays County was first being settled in the 1840s, before Kyle existed, some cowboys were riding down the road and found a man hanging from an oak tree. The cowboys buried the man at the base of this oak tree. The identity of the man and the reason for the hanging remain unknown today. In 1849, Willie Parks, an orphan boy was buried near the same tree. Later, Colonel Kyle donated 15 acres of land at the site for a cemetery.
